These Booking Conditions form the basis of your contract with us.

Booking Terms and Conditions

1. Contract

The Contract for a short-term holiday rental shall be made between the Client named on the booking system and EKO Properties Ltd. The Contract shall be governed by UK Law. It will be entered into when the deposit is processed and EKO Properties Ltd issues the confirmation letter. The Contract will be subject to all the following booking conditions. The Client should check the confirmation form carefully.

2. Payment 

A deposit of one third of the rental fee is payable if the booking is made more than three months before the commencement of the rental. The balance of the rental fee and a cautionary deposit of £1500 for Tregulland, £1500 for Barford, £1000 for Pentire Penthouse and £500 for Blackbird Boat  (see further details 3. below, applicable to all rental) is payable three months before the booking date. Non-payment of the balance of the rental on or before the due date shall be construed as a cancellation of the contract by the Client. For bookings made less than three months before the commencement of the rental, the total rental fee is payable. The cautionary deposit must be paid no less than 2 weeks prior to arrival with cleared funds.   Payment can only be accepted by recognised payment card or bank transfer and must be denominated in sterling (UK pounds). For properties booked less than three weeks before your arrival date your booking must be paid for in full, by bank transfer or card transfer along with the cautionary deposit. 
We do not accept cheques. We do not accept payments in installments. 

3. Cautionary Deposit

A cautionary deposit of £1500 for Tregulland, or £1500 for Barford Beach House, £1000 for Pentire Penthouse  and £500 for Blackbird  is payable no later than 2 weeks  before the booking date. You are required to keep the property clean and in good order and will be responsible for any breakages (see 10. and 11. below).  Accompanied pre and post inspections with guests are available upon request in advance. We will deduct from the Cautionary Deposit the cost of remedying any breach of these obligations together with the cost of any service or goods provided. The whole amount, or the balance after any deduction, of the Cautionary Deposit will be refunded to you following the end of the letting.    Please note from the agreed return date some credit and debit cards can take up to  14 days to receive the refund and it to show on your statement.    

4. Cancellation

Any cancellation made by the Client for whatever reason shall be in writing and emailed to EKO Properties Ltd at the following email address hello@tregulland.co.uk . The client should ensure receipt of this email and call for an acknowledgement and speak to someone if none is received by return. (+44)1566 770880

EKO Properties Ltd will endeavour to re-let the property by making the dates available again on the website and all portals and agents used at that time. If we are unable to re-let, the full balance owing will remain payable by you and the deposit will not be refunded. If EKO Properties Ltd only succeeds in re-letting the property for part of the period booked it shall refund an amount equal to the money paid less (1) the rental for the period which is not re-let and (2) an administrative charge of £100. If EKO Properties Ltd is unable to re-let the property at all then all monies paid by the Client shall be forfeit to EKO Properties Ltd. Any balance owing will remain payable by you. EKO Properties Ltd strongly recommends Clients take out Cancellation Insurance as the above refund terms are non-negotiable.

5. Changes of Date

EKO Properties Ltd may consider a request from a client to change the dates of the booking after confirmation has been issued. Agreement will be given where the request is received more than six months away from the start of the booking, subject to availability of the property.

6. Period of Hire

Rentals commence, unless otherwise notified, at 4.00 pm on the day of arrival and terminate at 10.00 am on the day of departure. We reserve the right to charge a reasonable late check out fee.   

July 2020 - Temporary Covid risk management check in time 5pm and check out 9am.  Guest are required to bag their own laundry - separating wet and dry linen in the bags provided

 7. Noise

Our properties are in tranquil locations and consideration must be shown and demonstrated at all times; this is not the venue for loud music or noise. Please be aware that the person making the booking is responsible for ensuring that the noise policy is adhered to by all members of the group at all times. In particular music that can be heard outside the house and noise after 9pm must be avoided as we have neighbours close by. Please see Appendix One for the noise policy.

8. Use of Property

The number of persons occupying a property must not exceed the maximum number stipulated on the booking form. The property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without the written consent of EKO Properties Ltd. EKO Properties Ltd reserves the right to refuse entry to the entire party if these conditions are not observed. 

Catering  Please note: if you are using a caterer during your stay please ensure they have visited the property beforehand and that they have public liability cover to the value of £5 million.  Please ensure you send a copy of the insurance certificate to hello@tregulland.co.uk 

9. Complaints

Should there be any cause for complaint during the occupation of the property it must be notified promptly to EKO Properties Ltd and in case of serious problems confirmed in writing.

10. Breakages or Damage

The Client is legally bound to reimburse EKO Properties Ltd for replacement, repair or extra cleaning costs on demand. These costs will be deducted from your cautionary deposit, but are not limited to that amount. You will be billed for the difference between this and the actual cost of the repairs.

11. Care of the Properties

The Client shall take all reasonable and proper care of the property, inside the house and in the garden (if applicable), and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the rental period as at the beginning. Failure to meet this standard will result in a cleaning charge against your cautionary deposit.

12. Health and Safety when staying at a Tregulland & Co property (Tregulland Cottage & Barn, Pentire Penthouse, Barford Beach House)

Tregulland Cottage, Barn, Grounds and Lake

The Client shall take all reasonable and proper care and observe the notices and rules relating to Health and Safety around the property, grounds, river and lake.  Clients should note that no swimming is permitted in the river or lake.  Children should be supervised at all times around the grounds, river, lake, pool house and facilities and woodburners and cookers in the Cottage and Barn.

Please refer to the guest information packs on how to ignite the fires.  Guests who are unfamiliar with setting fires should ask for further guidance if required. 

Fire prevention

Within the properties Fire extinguishers are situated on each floor and fire blankets near the cooking points and woodburners for guests use in the event of a fire.

In the event of an emergency guests should dial the emergency services on 999 immediately.  There are telephones in the entrance halls of both the Cottage and Barn.  

Leisure facilities - Swimming Pool, Steam Room and Hot Tubs

The main pool at Tregulland l is 12m long x 5m wide and 1.2m deep. Guests are asked to comply with the safety notices by the main entrance door when arriving at the Pool House.   

Guests should note that there are no life guards on duty at the swimming pool and guests are advised not to swim alone.  Children should be supervised at all times and non swimmers should not enter the swimming pool. 

Please refer to the Guest Information for guidance on using the hot tubs at our properties.  Guests are also asked toread and comply with the safety notices displayed prominently by the steam room and hot tubs.  At Pentire Penthouse guests must sign and acknowledge the Hot Tub Declaration before check in.   

Children under the age of 16 are not permitted to use the steam rooms, saunas or hot tubs

Dutch Hot Tubs at Barford and Tregulland

The fire surround and pipes leading into the tub are extremely hot when in use.  All guests should take care when stoking the fire, entering and leaving the tub.  Children under the age of 16 are not recommended to use the hot tub.  Children should take care around the hot tub to avoid the fire.

13. Pets

Well behaved pets are allowed at Tregulland and Barford on the condition that any pets have their own baskets / sleeping arrangements and that no animals are left alone in the house.  The charge for animals is £75 per pet.  You must clear up and dispose of all dog poo yourself - failure to do so/check adequately may result in money being retained from your deposit.  Dog poo bins are provided at our houses.

14. No Smoking Policy

 All of our properties are entirely non-smoking.  Ash trays are provided outside at the properties, cigargette ends should not be left on the floor but placed in these ashtrays. 

15. Liability

EKO Properties Ltd (for itself, its employees and agents) shall not be liable to the Client or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred, arise out of or in any way connected with the rental. No term of the Contract is enforceable under the Contracts (Rights of The Third Parties) Act 1999 by a person who is not a party to the Contract. If the property which the Client has booked becomes unavailable or unusable for some reason prior to the date of a booking, then EKO Properties Ltd obligation will be to (1) use their best endeavour to find a suitable alternative property, or failing which (2) to reimburse the Client for any monies paid.

16. Warranties

EKO Properties Ltd does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its servants.

17. Website and advertisements

The Owners aim to ensure that the information and descriptions provided are accurately conveyed on the official website and any authorized third-party websites or advertisements. There may be small differences between the actual accommodation and its description as we are always seeking to improve services and facilities. There are many unauthorised websites listing holiday cottages, we cannot accept responsibility for any mis-description by these sites. Occasionally, problems mean that some facilities or services become unavailable, and if this is the case we will tell you as soon as reasonably practical after we have been made aware of the situation. Similarly, we cannot accept responsibility for any changes or closures to local area amenities or attractions mentioned on the website or advertised elsewhere. We reserve the right to adjust the prices of a break if there has been an error in displaying an incorrect rate on our website or any associated third party websites.

18. Right of Entry

EKO Properties Ltd shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

19. Children

Guests must accept responsibility for the safety of their children who must be supervised at all times.

20. Cancellation Insurance

We advise all our customers to obtain cancellation insurance.  We advise that you contact an isurance broker for a quote for travel or event insurance.

21. VAT

All rates are inclusive of VAT.

22. Pricing

We reserve the right to change the advertised prices of our properties at any time without prior notification.  We will confirm the price of your holiday at the point of booking and the rental price agreed for the property (excluding any extras), as specified on the booking form and in the confirmation letter, will remain firm and will not be changed under any circumstances. All rates are inclusive of VAT.

TERMS AND CONDITIONS APPENDIX ONE

NOISE POLICY: TREGULLAND

Tregulland and Barford are set in its own land and Pentire on the top floor of an apartment block.  We do have neighbours close by whose needs we respect - and who are used to enjoying a peaceful, tranquil environment in this lovely location.  We therefore ask all our guests to show consideration to the environment and our neighbours in all matters, and especially with regard to noise. To help ensure everyone's holiday goes well, we ask you to respect the following noise rules:

  1. After 9pm and before 9am please use the terraces and gardens around the house as quiet areas
  2. Low level music on terraces and lawn areas only.
  3. Please limit any music playing or television noise inside the house so it cannot be heard outside.
  4. Please do not turn up music within the property to provide music outside, for example on the terraces
  5. Please show consideration for our neighbours in the early morning and late evening
  6. If you are having any deliveries or ordering taxis please ensure they have clear directions to Tregulland

 

The vast majority of our guests will of course behave with great consideration to our neighbours and would never intend to offend but observing our noise policy will remove any potential for the harmonious environment to be disturbed.

Guidelines for the Leisure Facilities

These protocols are designed to promote a safe, hygienic and enjoyable place for you to spend your leisure time. 

  • Guests must read and observe the leisure facilities rules which are prominently displayed in the pool area before using the facilities.
  • Guests are not permitted to use the leisure facilities if they have consumed alcohol. 
  • Only guests over the age of 16 are advised to use the leisure facilities 
  • Guests must cease using the leisure facilities if they feel unwell at any time and consult a doctor.
  • Always be respectful of and courteous to other users.
  • Before entering any of leisure facilities you must shower.
  • Please shower between using different wet area facilities.
  • Please remove all deodorants, make-up and perfumes.
  • No glass or food shall be taken into the pool area at any time.
  • In the swimming pool and pool side running, jumping, diving or unruly behaviour is prohibited and the use of snorkels, flippers and beach balls is also not advisable.
  • The Owners shall not be responsible for the personal belongings of the Guests.
  • Please report any faults with facilities to us Shanks, Property Manager

 Liability Disclaimer

Guests making use of the leisure facilities are responsible for ensuring that they are properly equipped and that their state of health and physical condition are such as not to involve any risk to him or herself or any other person making use of the facilities. It is hereby understood and agreed the Owners accept no responsibility for accident, injury, illness or misadventure caused to or suffered by guests on the premises howsoever caused. Guests are responsible for their own insurance in respect of injuries suffered, loss or damage to equipment.
